Article 1 - Contract This seasonal rental contract is reserved for the exclusive use of the rental and accommodation in pornichetplage at the address 82 av du littoral 44380 Pornichet. Article 2 - Duration of stay: The tenant signing this contract concluded for a fixed period may not under any circumstances avail himself of any right to remain on the premises at the end of the stay. Article 3 - Conclusion of the contract: The reservation becomes effective as soon as the tenant has sent the owner a deposit of 50% of the total amount of the rental and a copy of the signed rental contract. The lease concluded between the parties to this deed cannot under any circumstances benefit, even partially, third parties, natural or legal persons, except in the written agreement of the owner. Any violation of this last paragraph would be likely to result in the immediate termination of the lease to the detriment of the tenant, the proceeds of the rental remaining definitively acquired by the owner. Article 4 – Realisation of the file. The surname, first name and age of each tenant will be requested before arrival by our services including those of your children. The age of the children is calculated in relation to their birthday on the start date of the stay. An official document justifying the age of the children may be requested at the beginning of the stay. Minors unaccompanied by their parents or an adult legal guardian cannot be admitted for obvious security reasons (weather alert, hospitalisation, severe bad weather, illness...) Accepted means of payment Bank transfer Credit card: Mastercard, Eurocard, Visa, s Secure online payment on the website It is imperative to mention the reference of your reservation with your payment Article 5 - Rates The rates on our presentation sheets of the cottages the website include all taxes, excluding tourist taxes (and except excessive consumption). Our prices are calculated on the basis of the VAT rates in force and are therefore subject to change in the event of their changes. In case of refusal to pay the balance on the day of arrival, Pornichetplage reserves the right to cancel your stay. A collection fee of €40 will be charged. Article 6 - Taxes and contributions You will find the amount of the tourist tax and other possible taxes relating to your accommodation in the Rates section (ask by email pornichetplage@gmail.com) Article 7- Capacities: The number of people indicated per accommodation in our rates and brochures corresponds to the maximum authorised occupancy given the available equipment. It cannot be exceeded for safety and insurance reasons. The management reserves the right to refuse you access to the accommodation if the number of people exceeds the maximum authorised occupancy. Article 8 Feasts are prohibited in the apartment. It must remain a quiet and friendly place without disturbing the neighbourhood Article 9 Modification of stay: Any change of stay requested in terms of dates, place, duration, number of people or family composition must be validated by our services. It may, if necessary, be subject to additional invoicing. In the event of external events beyond our control, we may have to modify or cancel your stay. Article 10 - No withdrawal: For reservations made by mail, telephone or internet, the tenant does not benefit from the withdrawal period, in accordance with Article L121-21-8 of the Consumer Code relating in particular to the provision of accommodation services provided on a date or according to a determined periodicity. Article 11– Cancellation by the tenant:. It is agreed that in case of cancellation/desistment: of the tenant: The reservation is non-refundable. Article 12– Cancellation by the owner: Case of force majeure; flooding, fire, death: a full refund will be made. Article 13 - Arrival: The tenant must show up on the specified day and time mentioned on this contract. In case of late or delayed arrival, the tenant must notify the owner. Article 14– Settlement of the balance: The balance of the rental is paid before entering the premises. Article 15– Inventory: An inventory is drawn up jointly and signed by the tenant and the owner or his representative on arrival and departure of the accommodation. This inventory is the only reference in the event of a dispute concerning the inventory. The state of cleanliness of the cottage at the arrival of the tenant must be recorded in the inventory. The cleaning of the premises is the responsibility of the tenant during the rental period and before his departure. The amount of any cleaning expenses is established on the basis of calculation mentioned in the descriptive sheet. Article 16– Security deposit or deposit: Upon arrival of the tenant, a security deposit whose amount is indicated on the front of this contract is requested by the owner €2000. This security deposit must be made by check to the order indicated in your contract. After the contradictory establishment of the exit inventory, this deposit is returned, less the cost of restoring the premises if damage was observed or missing property or the cleaning package in the event that the accommodation is not returned in a satisfactory state of cleanliness. Article 17 - Use of the premises: The tenant must ensure the peaceful nature of the rental and make use of it in accordance with the destination of the premises. Article 18 Capacity: This contract is established for a maximum capacity indicated on the rental contract. If the number of tenants exceeds the capacity, the owner can refuse the additional people. Any modification or breach of the contract will be considered at the initiative of the customer. Article 19 - Reception of animals: Pets prohibited Article 20 Insurance: The tenant is responsible for all damage arising from him. He is required to be insured by a holiday insurance contract for these various risks. Article -21 Valuables: it is recommended not to leave valuables in the accommodations. Article - 22 Payment of charges: the tenant must pay to the owner, Article - 23 Household Cleaning equipment is provided for the household during your stay. a paid cleaning package €150 for rentals of less than 3 nights; €200 more than 3 nights. Article 24 Complaints and disputes: Any complaint relating to the inventory and the state of the description during a rental must be submitted to the 2 parties by registered mail within 15 days of the stay. In the event of a technical problem, on leisure equipment (tennis, console rackets...), Pornichetplage will not be held responsible and no refund will be made. In the event of a dispute, only the jurisdiction of the Rennes Court is recognised. Article - 25 WIFI: wifi is free and secure The user with internet access undertakes not to use this access for the purpose of reproduction, representation, making available or communication to the public of works or objects protected by copyright or by a neighbouring right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without authorisation. The user is informed that a sharing software, when connected to the Internet, can automatically make downloaded files available. If a sharing software has been used to download protected works, it is therefore best to disable it. The user is also required to comply with the security policy defined by the owner as well as the rules of use of the network and computer equipment. It is recalled in this regard that the holder of Internet access is required to secure this access so that it is not used for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or a neighbouring right, under penalty of criminal liability. This responsibility of the access holder does not in any way exclude that of the user who may be accused of a crime of counterfeiting (Article L. 335-3 of the Intellectual Property Code). Article 27: Smoking - Smoking is prohibited inside the dwelling. CKECK-IN / CHECK-OUT Check-in is from 4 p.m. independently thanks to our connected lock box. Check-out will take place at 10:00 a.m. at the latest. Any exit beyond 10:00 a.m. will be charged €25 per hour. Access will no longer be authorised by the connected lock and the start-up remote monitoring system. No remote monitoring system will be connected for the duration of the stay.
